Supporting national and international policy developments in the field of restorative justice is one of the core missions of the European Forum for Restorative Justice (EFRJ), the largest network on restorative justice in Europe. Promoting international information exchange is key to stimulate dialogue between practitioners, policy-makers and also researchers. With this in mind, the EFRJ Policy News aims at making accessible the latest national and international policy developments and relevant research findings in the field of restorative justice. The Restorative Justice Policy News will closely follow the activity and contribution of the EFRJ at all policy levels and serve as an opportunity to promote the talks and contributions coming from our members engaged in policy-related work as well as from national and international policy makers.

From Venice to Pamplona:
How European Soft Law Can Influence The Development of Restorative Justice

In this article, Jorge Ollero analyses the contents of the Law on Restorative Justice in Navarra and explains how the Council of Europe’s recommendations were influential in its creation. Through his analysis, Ollero discusses possibilities for regulation of restorative justice, using the example of Spain where the central government has exclusive legislative powers over criminal proceedings.

Reaction to the Revision of the Victims’ Rights Directive

With the EU Council's position on the Victims' Rights Directive, EU member states have shown little willingness to commit to enhancing victim rights. They have largely rejected or diluted the EU Commission’s proposals, turning obligations into mere options. The EFRJ, together with 51 other organisations, signed the statement promoted by Victim Support Europe (VSE) to show solidarity with victims of crime and urge all EU Member State to honour commitments to victims of crime by adopting a strong Victims’ Rights Directive as the cornerstone legislation for all victims of crime.

The European Forum for Restorative Justice (EFRJ) sent feedback to the European Commission to assess the effect of the EU 2021-24 Strategy on Judicial Training. Our feedback promotes the strengthening of restorative justice frameworks across the EU.

It all started from a period of stagnation in its application, due to the fact that prosecutors and judges found it time-consuming and burdensome compared to the traditional criminal system. The United Nations Basic Principles on the use of Restorative Justice presents one coherent definition of restorative justice; whereby the Council of Europe Recommendation on Restorative Justice in Criminal Matters (CM/Rec(2018)8) offers the most innovative and comprehensive international document on restorative justice. At the European Union level, restorative justice is mainly regulated by the Victims’ Rights Directive (2012/29/EU).
